The rules and regulations for the use of Pharmacy Space's Website.
These Terms of Service ("Terms") constitute a binding legal agreement between you ("User", "you") and Pharmacy Space (ABN 32 694 035 919) ("we", "us", "our"), the operator of the Platform accessible at pharmacyspace.com.au.
By accessing or using the Platform in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform. Your continued use of the Platform following any variation to these Terms constitutes acceptance of the varied Terms.
Contract formation is governed by the Electronic Transactions Act 1999 (Cth). Your acceptance of these Terms by electronic means (including by clicking "I agree" or by continued use) constitutes a valid and binding contract.
While the Platform is primarily designed for adult professionals, individuals under 18 years of age (such as pharmacy students) may register for an account for educational purposes. If you are under 18, we encourage you to involve a parent or guardian when using the Platform.
The Platform is designed for use by the general public, registered pharmacists, pharmacy students, pharmacy employers, and allied healthcare professionals in Australia. Certain features (including the Job Portal and CPD Tracker) are intended exclusively for registered health professionals.
3.1 To access certain features, you must create an account by providing accurate, current, and complete information including your name, email address, date of birth, gender, and (for the Job Portal) your AHPRA registration number.
3.2 You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorised access to or use of your account.
3.3 We reserve the right to refuse registration or cancel accounts at our discretion, including where we reasonably believe that information provided is inaccurate or that the account is being misused.
The Platform provides the following features (collectively, the "Services"):
Clinical Calculators — decision-support tools including IBW, BMI, BSA, CrCl, and paediatric dosing calculators;
Drug Database — pharmaceutical reference information sourced from the TGA and PBS;
News and Announcements — curated Australian pharmacy and healthcare news;
Job Portal — connecting pharmacists with shift and employment opportunities;
CPD Tracker — tools to record and manage Continuing Professional Development in accordance with AHPRA requirements;
Pharmacy Hub — a professional community and resource centre;
Messaging — secure in-platform communications between users.
The Services are provided for professional informational and educational purposes. They do not constitute clinical, medical, legal, or financial advice.
5.1 You agree to use the Platform only for lawful purposes and in accordance with these Terms.
5.2 You must not:
use the Platform to transmit content that is unlawful, defamatory, harassing, abusive, fraudulent, or otherwise objectionable;
impersonate any person or misrepresent your professional qualifications or registration;
attempt to gain unauthorised access to any part of the Platform or its supporting infrastructure;
use automated tools, bots, or scrapers to extract content from the Platform without our prior written consent;
use the Platform in a way that may harm other users, third parties, or the reputation of the Platform;
violate any applicable law or regulation, including the Privacy Act 1988 (Cth), the Spam Act 2003 (Cth), or professional obligations under the Health Practitioner Regulation National Law.
6.1 All original content, design, graphics, software, and materials created by us on the Platform are owned by or licensed to Pharmacy Space and are protected by Australian and international intellectual property laws. We do not claim ownership or intellectual property rights over third-party news articles, graphics, or aggregated content sourced from external publishers, which remain the property of their respective owners.
6.2 You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for its intended purposes. This licence does not permit you to reproduce, distribute, modify, or commercially exploit any part of the Platform without our prior written consent.
6.3 By submitting any content to the Platform (including job listings, comments, or messages), you grant Pharmacy Space a non-exclusive, royalty-free, worldwide licence to use, store, reproduce, and display that content as necessary to operate the Services. For private records such as your CPD records, our licence is strictly limited to storing the data to provide the tracking service to you and for internal, de-identified analytical purposes. We do not commercialise, reproduce or publicly display your CPD records. You retain ownership of all your content.
6.4 You warrant that any content you submit does not infringe the intellectual property rights of any third party.
7.1 Users who elect to use the Job Portal's payment and payroll features may be required to provide sensitive financial information including Tax File Numbers (TFN), Australian Business Numbers (ABN), bank account details, and superannuation fund information.
7.2 This information is collected solely for the purpose of facilitating employment and payroll arrangements between pharmacists and pharmacy employers on the Platform. It is handled in accordance with our Privacy Policy and applicable Australian privacy and taxation law.
7.3 [REVIEW REQUIRED] Where the Platform facilitates any payment or subscription service, refund rights are governed by the ACL. Consumers may be entitled to a refund where a service fails to meet a consumer guarantee under the ACL (s.64). Legal review required to confirm current payment model and insert specific refund terms.
8.1 We may suspend or terminate your account at any time without notice if we reasonably believe you have breached these Terms, engaged in fraudulent activity, or if required by law.
8.2 You may delete your account at any time by contacting us. Account deletion requests will be processed within 30 days. Deletion of your account does not automatically delete all personal information held about you — please refer to our Privacy Policy for data retention obligations.
8.3 Upon termination, your licence to use the Platform ceases immediately.
9.1 To the maximum extent permitted by the ACL, Pharmacy Space's total liability to you for any claim arising out of or in connection with these Terms or the Services shall not exceed AUD $100 or the amount you have paid to us in the 12 months preceding the claim, whichever is greater.
9.2 Pharmacy Space is not liable for any indirect, consequential, incidental, or special loss or damage including loss of profits, loss of data, or personal injury arising from use of the Platform.
9.3 Nothing in these Terms excludes, restricts, or modifies any right or remedy you may have under the ACL that cannot lawfully be excluded. Consumer guarantees under the ACL are not affected by this clause.
You agree to indemnify and hold harmless Pharmacy Space, its officers, employees, and agents from and against any claim, liability, loss, damage, or expense (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Platform, or your infringement of any third-party right.
11.1 If you have a complaint, please contact us in the first instance via the Contact page. We aim to acknowledge complaints within 5 business days and resolve them within 30 days.
11.2 If we are unable to resolve your complaint internally, you may refer the matter to the relevant external body, including:
The Australian Competition and Consumer Commission (ACCC) for consumer law matters;
The Office of the Australian Information Commissioner (OAIC) for privacy-related complaints;
The relevant state or territory Fair Trading authority.
11.3 Disputes that cannot be resolved through the above process shall be referred to mediation in Victoria before either party may commence litigation.
These Terms are governed by the laws of Victoria, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Victoria.
We may vary these Terms at any time. Where a variation materially affects your rights, we will provide at least 14 days' notice by email or prominent notice on the Platform. Continued use of the Platform after the effective date of a variation constitutes acceptance.
